Additional Terms for Installers
Version 31 October 2026
This translation has the same content as the Dutch version.
These terms apply to businesses that use BoilerBuddy professionally as an installer: installing and managing devices at customers' premises with colleagues, letting customers follow along and, optionally, a listing in the installer directory. BoilerBuddy is a trade name of Peters Development, Bijsterhuizen 2414, 6604 LL Wijchen (the Netherlands), Chamber of Commerce (KvK) 77119185, VAT number NL003151172B94 ("we"). By "you" we mean the business that is registered as an installer in BoilerBuddy.
1. Who these terms are for, and how they fit together
- These terms apply to an organization we have approved as an installer, and to everything its members do in BoilerBuddy on its behalf.
- They apply alongside the terms of use. If they conflict, these terms prevail for business use. The rules in the terms of use that only apply to consumers, such as the right of withdrawal and the court where you live, do not apply to your business.
- The data processing agreement for your customers' data is part of these terms (Article 6). Whoever accepts these terms thereby also enters into the data processing agreement.
- Whoever accepts these terms on behalf of the business, when applying or later, declares that they are authorized to bind the business to them.
- General terms or purchasing conditions of your business do not apply to BoilerBuddy.
- Buying a BoilerBuddy Alpo is not covered by these terms.
2. Applying and approval
- You apply for your business through the page for installers or in the portal, with your company name, Chamber of Commerce number, address, country, phone number and an email address for invoices. These details must be correct, and you keep them up to date under Organization.
- We review every application ourselves. We may reject an application; we tell you the reason by email. You can apply again afterwards.
- Until we approve your application, nobody can work in your business and you pay nothing.
- We may withdraw an approval if your business seriously or repeatedly breaches these terms, has provided incorrect details, misuses BoilerBuddy or no longer exists. Where possible, we warn you first and give you a reasonable period to put it right. After that, Article 11 applies.
3. Members and roles
- Your colleagues are members of your business, as owner, admin or technician. What each role may do is in the documentation. There is always at least one owner.
- You decide who is a member and with which role. What a member does in BoilerBuddy, they do on behalf of your business. Your business is responsible for it as for its own actions.
- Each member works with their own account. Do not share accounts. Remove a colleague who leaves from the members straight away; they then lose all access. We recommend that owners and admins turn on two-factor authentication.
- Devices belong to the business, not to a member. A member who leaves takes nothing with them.
- Your members' accounts are personal accounts. We process that data ourselves, as described in the privacy policy.
4. Devices, customers and sharing
- A device that a member adds while working in your business belongs to your business and is on your subscription. An installer has no maximum number of devices.
- You only connect a device to a system for which you have permission from whoever is in charge of it, and you do so professionally and according to the installation instructions. The work on the system and the arrangements with your customer are a matter between you and your customer; we are not a party to them.
- You can record customers, with their contact details, notes and locations, and put their devices under them. Notes are only visible to the members of your business. The name, description and address of a location, and where a device is in the building, are also visible to whoever follows along with the customer.
- An owner or admin can invite someone to follow along with a customer. They receive an email with a link that works for 7 days, once, and only for that email address. Whoever follows along sees all devices of that customer, including those added later, and receives their alerts. Only invite people who belong to that customer and expect it.
- A customer can share their own device with your business so that you manage it. The device then remains the customer's, the customer pays for it and can stop sharing at any time.
- You use access to customers' devices and data only for your services to those customers.
5. Transferring to a customer
- An owner or admin can transfer a customer's devices to that customer: the customer is offered them and takes them over into their own account. Until they take them over, they remain your business's, and you can withdraw the offer.
- Once the customer takes over a device, it is theirs, with the readings it already had. From that moment it is on their subscription and no longer on yours; you pay for the days before, charged per day. The customer has a trial of 30 days from creating their account. If they do not start a subscription after that, the device is locked, for them and for you.
- If you chose so when offering it, you keep managing the device as installer. Sharing, transferring, deleting and re-pairing are then up to the customer, and they can end your access at any time.
- Agree with your customer who pays. BoilerBuddy does not bill your customers for devices that belong to your business; whether and how you pass those costs on is up to you.
- After the transfer, we process that device's data for the customer themselves, under the terms of use and the privacy policy. The customer stays in your own customer list; that data remains your records.
6. Your customers' data
- For the personal data you record in BoilerBuddy or have it process, you are the controller within the meaning of the GDPR, and we are your processor. This covers your customers (name, email address, phone number, address, notes and locations), the readings of your business's devices at those customers, the invitations to follow along, and the requests that reach you through the installer directory.
- That processing is governed by the data processing agreement. It is part of these terms.
- You make sure you have a legal basis for what you record, for example the contract with your customer, and you tell your customers that you use BoilerBuddy and which data you keep in it, for example in your own privacy policy.
- Only record what you need. Do not enter special categories of personal data in BoilerBuddy, such as health data, and no citizen service numbers (BSN) or other national identification numbers.
- You answer your customers' questions about their data held by your business yourself. Much of it can be done in the portal: changing details, deleting a customer, ending follow-along access. We help where needed, as set out in the data processing agreement.
- What we process ourselves as controller, such as the accounts of your members and of customers who follow along, the devices a customer owns themselves, payments and forwarding a request from the directory, is described in the privacy policy.
7. Subscription and payment
- Price. BoilerBuddy costs €3.95 per device per month, including 21% VAT (€3.26 excluding VAT), for the devices that belong to your business. Your invoice shows the VAT separately. A running subscription keeps the price it started with, until a price change under paragraph 8.
- VAT across borders. If your business is established in another EU country and your company details include a valid VAT number, VAT is reverse charged: you pay the price without VAT, and the invoice states that VAT is reverse charged. This applies as soon as we have confirmed the number in the European VAT register (VIES). If your business is established outside the EU, we do not charge Dutch VAT.
- Trial. Your business has one trial. It starts when we approve your application and lasts 30 days, unless we agree otherwise with you on approval. After that nothing continues automatically: without a subscription your business's devices are locked (paragraph 7).
- Taking out and paying. An owner or admin takes out the subscription on the Subscription page. You pay monthly in advance, through Mollie, by direct debit (the first time with iDEAL) or credit card. You pay the first month straight away when you take it out, even if your trial is still running.
- Per device. You pay for the number of devices of your business. If a device is added or removed halfway through a month, for example by a transfer, we charge it per day. While the subscription runs, you pay for at least one device.
- Invoices. For every payment you receive an invoice, with the company details under Organization: name, address, country, Chamber of Commerce and VAT number. You find your invoices under Manage subscription. You make sure those details are correct.
- Not paid. If a payment fails, everything keeps working for another 14 days after the paid period, while we retry the payment. If it still doesn't go through after that, or your trial has ended without a subscription, your business's devices are locked: the BoilerBuddy Alpo keeps measuring and the readings are kept, but the dashboard, charts, savings and alerts are closed, also for the customers who follow along, and no more alerts go out. It is up to you to inform your customers. Once you pay again, everything is back.
- Price change. We announce a new price by email at least 30 days in advance, and it never takes effect in the middle of a paid period. If you don't agree, you can cancel free of charge before that date.
- Cancelling is possible at any time, without notice period, on the Subscription page. Everything keeps working until the end of the period you paid for.
- No right of withdrawal. Your business uses BoilerBuddy as a trader. The consumer right of withdrawal therefore does not apply. We do not refund a paid period that has started, except if we end the service or terminate the agreement without you having done anything wrong (Article 11), or if the law requires it.
8. Listing in the installer directory
- What it is. In the installer directory people find an installer who works with BoilerBuddy, by country and region. A listing is optional and separate from the subscription. An owner or admin manages it on the Listing page.
- What it shows. Your company name, town and country from your company details, and what you put on your profile yourself: a short description, a description, website, email address and phone number, your work area, services, certifications with their number, logo and photos, and details such as the year you were founded, the size of your team, your languages, brands, who you work for and whether you offer an emergency service. If you turn it on, it also shows how many systems you manage with BoilerBuddy; we count that ourselves, in steps from five.
- When you are listed. When your listing is paid (or we have given you a period free of charge), Show in the directory is on, you have chosen at least one work area and one service, and we have not hidden it. The order in the directory changes daily. We do not promise a position or a number of requests.
- Price. A listing costs €500 per year, excluding VAT. For a business in the Netherlands, 21% VAT is added. For a business in another EU country, VAT is reverse charged once we have confirmed the VAT number in VIES; until then you pay 21% VAT, which you reclaim yourself. Outside the EU we charge no VAT. When you pay, you see the amount you pay. You pay in advance, with a single payment through Mollie, and receive an invoice for it. This is also possible during your trial.
- Period and renewal. A payment gives a listing for 12 months, from the moment of payment. Renewing is possible from 60 days before the end; the new year then follows on from the old one. Nothing renews automatically. If your listing is on, the owners and admins receive a reminder 30 days before the end, and another one when it has expired. If you don't pay, you disappear from the directory on the end date. Your profile is kept: once you pay, you are listed again.
- Chargebacks. If you charge back a payment, or it is refunded to you in full, the year paid with it lapses.
- Your content. You are responsible for what is on your profile. It is accurate, not misleading and does not infringe the rights of others. Certifications you list, you really hold, they are valid and the number is correct. We do not check certificates; your profile states that it is your own declaration.
- Logo and photos. You guarantee that you have the right to use your logo, photos and texts, and that people who are recognizable in a photo have agreed to it. Do not show customers' details in photos, such as an address or licence plate, without their consent. You grant us the right to show your logo, photos and texts in the directory free of charge while your listing runs, and to resize them for that and store them without the data embedded in the file.
- Hiding. We may hide a listing if it breaches these terms, is misleading or unlawful, a certification is not correct, or we receive well-founded complaints about it. You see the reason at the top of the Listing page. Once you put it right, we show it again. If we hide it because of your fault, we refund nothing. If we hide it without you having done anything wrong, or we stop the directory, we refund the remaining part of the year pro rata.
- Requests. Through the form on your profile, people send you a request, with their consent to forward it to you. You receive it by email, and you find it in the portal under Requests for 12 months; after that we delete it automatically. For the request you are the controller. You use the data only to respond to that request and what follows from it, not for newsletters or other marketing without the sender's consent, and you do not keep it longer than necessary. What you agree with the sender, you agree with them; BoilerBuddy is not a party to it.
9. Availability
Article 6 of the terms of use also applies to your business. We do our best to keep BoilerBuddy working well and without interruption, but we do not guarantee availability or response times.
10. Liability and indemnity
- Article 10 paragraph 1 of the terms of use also applies to your business: we are not liable for damage to systems, for missed or late alerts or for decisions based on the savings estimate.
- If we are liable after all, our liability is limited to the amount your business paid us in the twelve months before the event that caused the damage, for the subscription and the listing together.
- We are not liable for indirect damage, such as consequential loss, loss of profit, lost revenue, damage from downtime, reputational damage or claims by your customers.
- These limitations do not apply if the damage results from intent or gross negligence on our part.
- Report damage as soon as possible. A claim lapses if you have not reported it to us in writing within twelve months of discovering the damage.
- Your business indemnifies us against claims by your customers and by others arising from your work on systems, your arrangements with your customers, the data you record and how you use it, the content of your listing, or a breach of these terms or the GDPR by your business or your members. This includes reasonable costs of defence. It does not apply to the extent the claim results from our own fault.
11. Ending
- Duration. These terms apply as long as your business is registered as an installer in BoilerBuddy.
- Your business stops. First cancel the subscription, then ask us by email at info@boilerbuddy.eu to delete your business. You cannot delete an installer yourself in the portal. Beforehand, transfer the devices that should keep working at your customers (Article 5), and request an export of your data if you want one (see the data processing agreement).
- We stop. We can terminate the agreement with three months' notice. Without notice if your business seriously breaches these terms, does not pay even after a reminder, goes bankrupt or ceases to exist, or if we withdraw an approval under Article 2 paragraph 4. If we stop the service altogether, Article 6 paragraph 3 of the terms of use applies.
- What happens when we delete your business:
- devices that still belong to your business are deleted with their readings and alerts. A BoilerBuddy Alpo at a customer can then no longer send anything, and whoever followed along no longer sees it;
- your customers, their notes and locations, the invitations, your listing with logo and photos, and the requests are deleted;
- devices you transferred to a customer remain that customer's, with their readings and on their subscription. Your access ends;
- devices customers shared with your business remain those customers'. The sharing ends;
- your members keep their personal accounts;
- we keep payments and invoices for seven years, because Dutch tax law requires it.
- Time limits. After the end, we delete your business's data within 30 days; 14 days later it is also gone from the backups. If you want an export, request it before the end or at the latest within those 30 days.
- Paid in advance. If the agreement ends at your request or through your fault, we do not refund what you paid in advance. If we terminate without you having done anything wrong, we refund the remaining part of the subscription and the listing pro rata.
- Whatever by its nature continues to apply after the end, such as Articles 6 and 10 and the data processing agreement until all data has been deleted, continues to apply.
12. Changes to these terms
We may change these terms. We will notify the owners of your business by email of substantial changes at least 30 days in advance. If you don't agree, you can terminate before the effective date. If you use BoilerBuddy for business after that date, the new terms apply.
13. Applicable law and disputes
- These terms and the data processing agreement are governed by Dutch law.
- If you have a complaint, email info@boilerbuddy.eu. We first try to resolve it together.
- If that fails, the District Court of Gelderland (Rechtbank Gelderland, the Netherlands) has jurisdiction, unless the law mandatorily designates another court.
